Prior Research Art and its Meaning

What search of the prior art:

The word of the search of the prior art consisting of two words, one is "before" and another is "art." refers back to the "existing prior knowledge" and the word art refers to the art collection, documentation and presentation. So in layman term we can say "Art to research, collect, document and present the information available before a certain point in time is the search of the prior art.

There are many types of search patents some of which are:
• Search patentability
• State of the art research
• Continuous research
• Violation Search
• Validity Search

Research from patentability:
This is the most common type of research firms in the patent arena to determine if an invention in question is within the scope of patentable subject matter. The search for patentability is made before submitting a patent application to determine the utility, novelty and non-obviousness of the invention in question in the light of any previous patent / s or section or literature .

Ongoing research:
Continued research is nothing more than an awareness of current research recently issued patents.

Search validity:
Search validity are generally made by companies or individuals to determine if it is possible to invalidate the patent of another. The researcher seeks patents or publications that can make other issued patents "obvious" the researcher can also watch public knowledge before belonging to the invention, technical error, fraud, or anything that may cause a patent to be declared invalid. Unlike the rest of the research validity research is done after a patent has been issued for an individual inventor. the validity search is usually performed by an entity of the offender, or potentially infringing the patent, or may be made by the patent owner or other entity that has a financial interest in a patent to confirm the validity of a patent.

Search Violation:
An investigation of the offense is done to determine if proposed product / service can affect or be covered by existing patents. This type of research covers only the current patent claims. Advantages of doing prior art searches:

• Is my patent worth spending money on? The means of novelty and non-obviousness of a patent is determined by the search for prior art.

Since a search of the prior art is to search different databases and documentation relating to the present invention can be easily determined if their idea was patented or not.

Because in search of the prior art in search of all databases firms to study all patents in this particular area and to define the qualitative and quantitative gap of the patent in question in relation to existing patents .
Prior art searches give examiners the opportunity to determine the patentability of applications
• Patent strength can be assessed by doing prior art searches

Supplies and tools to make the search of the prior art:
For US Patents / Publications

patent search can be done online. Office and US brands (1790-present) patents provides some online databases that can be accessed free of charge.

Patent search should be done using keywords or phrases that describe your invention. Patented online be sure to examine other patent states that the inventor tested.

Search strategy changes as needed.

BIB patents (CD, west) -check if you are on track, search patent, the BIB (1969) or the West (1971) for a class / subclass given. class, time (s) and relevant subclass (s) identified a list of all patent numbers (1790-present) assigned to each class and subclass to search

Search the entire patent document (microfilm), paper and CD-ROM, WEST or USPTO web; search text and drawings full of closely related patents to determine how they are different from the invention.
